Under LC section 4650, the insurer must begin payments within 14 days of learning about your injury. If they delay, your attorney can compel compliance.
Compensation for lasting impairment — Once your condition has stabilized, any permanent limitations you carry are evaluated and assigned a disability rating. This rating translates into a monetary award that compensates you for the lasting impact of your injury on your ability to earn a living.
Retraining assistance — If you cannot return to your former job due to permanent restrictions, California provides a supplemental job displacement voucher worth up to $6,000 for education and retraining at accredited institutions.
Tell your employer immediately, preferably in writing. Text your supervisor, send an email, or fill out an incident report form. Under LC section 5400, you have 30 days for a specific injury, but same-day reporting eliminates disputes about timing and establishes your credibility.
Your employer must hand you a DWC-1 claim form within one working day. If they do not, ask for it in writing. If they still do not provide it, contact the Division of Workers' Compensation directly. Filing the DWC-1 activates up to $10,000 in presumptive medical treatment.
Get examined as soon as possible. Be thorough and honest about every symptom. The doctor's initial report becomes the foundation of your medical record, and inconsistencies between early reports and later complaints give insurers ammunition to dispute your claim.
Before you speak with the insurance adjuster, speak with a lawyer. The adjuster will ask you questions designed to limit the insurer's liability. A lawyer prepares you for those interactions and takes over communications so you do not inadvertently harm your claim.
