Hurt at work? You deserve more than just first aid. Fight for full compensation.
By Eman Yazdchi, Esq. · Certified Specialist in Workers' Compensation Law
Getting hurt at work is disorienting. You are in pain, unsure whether you can pay your bills, and suddenly navigating a system you have never dealt with before. If you were hurt at work in Simi Valley, you do not have to figure this out alone. Yazdchi Law P.C. helps injured workers across Ventura County understand their rights, get the medical treatment they need, and collect every dollar of compensation California law provides — and we do not charge a fee unless we win your case.
The first thing to understand is that California's workers' compensation system is designed to provide benefits to any worker who is injured on the job, regardless of who was at fault. You do not need to prove your employer was negligent. Whether you slipped on a wet floor at a restaurant near the Simi Valley Town Center, strained your back lifting heavy equipment at a manufacturing plant off Tapo Canyon Road, or developed chronic shoulder pain from years of overhead work at a construction site, you are entitled to medical treatment, wage replacement, and disability benefits. But the system only works if you take the right steps — and take them quickly.
Under Labor Code section 5400, you have 30 days from the date of your injury to notify your employer in writing. After you report, your employer is required to provide you with a DWC-1 claim form within one working day. Once that form is filed, the insurance company has 90 days to accept or deny your claim. During those 90 days, the insurer must authorize up to $10,000 in medical treatment. If they delay or refuse, we step in and force the issue through the Oxnard WCAB.
Many Simi Valley workers hesitate to file a claim because they fear retaliation — being demoted, having their hours cut, or being terminated. California law explicitly prohibits this. Labor Code section 132a makes it illegal for any employer to discriminate against a worker for filing or even intending to file a workers' compensation claim. If your employer retaliates, you may be entitled to additional compensation including back pay, reinstatement, and a penalty of up to $10,000. We take retaliation cases seriously and pursue them aggressively.
When you are hurt at work, you need an attorney who will respond immediately — not one who assigns your case to a paralegal and checks in weeks later. Attorney Eman Yazdchi personally evaluates every case, develops a strategy tailored to your specific injury and employment situation, and stays involved at every stage. As a Board-Certified Specialist in Workers' Compensation Law, Eman has the expertise to handle everything from a straightforward sprain to a complex multi-body-part cumulative trauma claim.
