Does Workers' Comp Cover Shoulder Surgery in California?

Yes. California workers' comp covers your shoulder diagnosis, surgery, and recovery at no cost to you. It also pays you while you cannot work.

A torn shoulder changes everything. You cannot lift, reach, or sleep on that side. Some days you cannot work at all. That fear is real. You are not alone.

Many shoulder injuries at work need surgery. A rotator cuff tear or a labrum tear rarely heals on its own. You may need an MRI, then an operation, then months of therapy. The bills can look scary. You may also worry about your job and your family.

Here is the good news. Workers' comp should pay for all of it. You should also get a check while you heal. This page explains how the system works, in plain words. We also show you how to fight back if the insurer says no.

What Does Workers' Comp Pay For After a Shoulder Injury?

Workers' comp covers 100% of your shoulder care. That means the MRI, the surgery, the sling, and physical therapy. You pay nothing, with no copay.

California law gives you full medical care for a work injury. Labor Code 4600 says the insurer pays the whole bill. There is no copay and no deductible. Your doctor follows state treatment rules called the MTUS. These rules guide what tests and surgery you get. Good care should not cost you a dime.

You do not have to wait for full approval. The insurer must start your care right away. Up to $10,000 of treatment is covered while they investigate. That protection comes from Labor Code 5402. So your MRI or first visit should not stall. If they miss the 90-day deadline, your claim is presumed accepted. That rule works in your favor. Save every receipt and bill you get.

Most insurers use a doctor network called an MPN. You usually pick your treating doctor from that list. A good shoulder surgeon makes a real difference. How Do You Get Your Shoulder Surgery Approved?

Your surgery goes through utilization review first. If the reviewer denies it, you appeal through Independent Medical Review within 30 days. Many denials get overturned.

Before surgery, the insurer reviews the request. This step is called utilization review, or UR. A reviewer checks your file against the state rules. The rules let them approve, delay, or deny the surgery. Sometimes they ask your doctor for more proof. A weak request is easy to deny.

A denial is not the end. It is the start of your appeal. You ask for Independent Medical Review, called IMR. A new doctor reviews your records. Labor Code 4610.5 gives you 30 days to file. Do not miss that window. The IMR decision is final, so the proof must be strong.

How Much Money Do You Get While Your Shoulder Heals?

While you cannot work, you get temporary disability pay. It equals about two-thirds of your average weekly wage. It can last up to 104 weeks.

Shoulder surgery can keep you off work for months. During that time, you get temporary disability pay. People call it TD. It replaces about two-thirds of your lost wage. It helps you cover rent and food while you heal. The money is not a gift. You earned it.

Your first check should arrive fast. The insurer must pay within 14 days of learning you lost time. A late check adds a 10% penalty. The pay has a floor and a ceiling, set each year. Keep your pay stubs to prove your real wage. A higher wage means a higher check.

TD does not last forever. Labor Code 4656 caps it at 104 weeks. You have a 5-year window to use those weeks. If you still cannot work after that, other benefits may apply. Talk to a lawyer before your TD runs out. The chart below shows the 2026 rates.

What Is Your Shoulder Worth in a Permanent Disability Rating?

If your shoulder never fully heals, you get a permanent disability rating. It reflects lost range of motion and pays set weeks of benefits.

Many shoulders do not return to 100%. You may lose some reach or strength. The system measures this as permanent disability, or PD. A doctor measures how far your arm now moves. They compare it to a normal shoulder. It is not just about stiffness.

Your lost motion becomes a percent, from 0 to 100. That percent sets how many weeks of pay you get. Labor Code 4660.1 then adjusts it for your age and job. The number can move up or down. A younger worker or a heavy job can change it.

A higher rating means more money. Ratings of 70% or more add a lifetime pension. You may also get a $6,000 voucher to retrain for new work. The insurer may blame an old injury for part of your loss. We push back so your work injury counts. Your weekly PD check runs $160 to $290 in 2026.
