A San Marino work injury can feel private and awkward. Maybe you were hurt cleaning a home, trimming hedges, caring for a child, repairing a roof, or working near the Huntington Library. You may wonder if workers' comp even applies.

It often does. California workers' comp can pay medical care, two-thirds wage checks while you cannot work, permanent disability, mileage, and retraining help. You do not have to prove your employer was careless. You should report the injury in writing within 30 days, and the main filing deadline is usually one year.

San Marino claims often involve household staff, gardeners, nannies, pool workers, residential construction crews, school employees, and grounds or event workers near Huntington Drive. Yazdchi Law handles these cases at the Pomona WCAB. Call (661) 273-1780 for a free review.

Do you have a San Marino workers' comp case?

You may qualify if your San Marino job caused an injury, even in a home, garden, school, or private estate.

Workers' comp is not only for factories. San Marino work often happens in private homes, gardens, schools, and cultural spaces. A housekeeper can injure a back while lifting laundry. A gardener can fall from a ladder. A nanny can hurt a shoulder while lifting a child. A residential framer can suffer a head injury on a remodel.

The injury must be tied to work. That includes one event, like a fall, and repeated work, like years of kneeling, lifting, trimming, or cleaning. If the job made an old condition worse, that can still count.

Domestic service workers can be covered under California law. Immigration status does not remove your workers' comp rights. Cash pay, part-time work, or a small household employer can make the case more fact-specific, but those facts do not end the inquiry.

Labor Code section 4600: "Medical, surgical, chiropractic, acupuncture, and hospital treatment, including nursing, medicines, medical and surgical supplies, crutches, and apparatuses, including orthotic and prosthetic devices and services, that is reasonably required to cure or relieve the injured worker from the effects of his or her injury shall be provided by the employer."

What benefits can you receive?

A valid claim can cover medical treatment, temporary wage checks, permanent disability, travel mileage, and retraining help when your old job ends.

Medical treatment is the core benefit. The insurer should pay for care needed to cure or relieve the work injury. That may include urgent care, imaging, therapy, injections, surgery, medicine, and follow-up visits.

Temporary disability helps replace wages when your doctor says you cannot work or gives limits your employer cannot meet. The usual payment is two-thirds of your average weekly wage, subject to state minimum and maximum rates. For most injuries, temporary disability is limited to 104 weeks within five years.

Permanent disability pays for lasting loss after treatment becomes stable. A doctor rates the injury. The rating formula weighs your age and occupation. A gardener, housekeeper, nanny, or construction worker may have different work demands than a desk worker.

Mileage to approved medical visits can be reimbursed. If you cannot return to your old job, a retraining voucher may help pay for school, equipment, or job placement services.

How much is a San Marino workers' comp claim worth?

Value depends on diagnosis, rating, job duties, future care, wages, and whether the insurer proves a valid reduction with medical evidence.

A San Marino claim is valued by evidence, not by the neighborhood. A fall from a ladder, a cleaning-related back injury, and a hand injury from tools can have very different values. The medical reports carry the most weight.

For post-2013 injuries, the rating starts with the doctor's impairment score. California applies a 1.4 multiplier, then weighs age and occupation. That final rating controls the permanent disability payment weeks.

Injury severityTypical permanent-disability ratingApproximate value range
Minor strain or sprain0% to 10%$0 to $10,000
Moderate injury needing surgery10% to 30%$10,000 to $50,000
Serious injury or single-level fusion30% to 60%$50,000 to $150,000
Severe or multi-level injury60% to 99%$150,000 to $500,000+
Catastrophic spinal-cord or brain injuryOften 70% to 100%Can exceed $1,000,000

These are general California ranges, not a prediction. Your actual award depends on your disability rating, age, occupation, and future medical care. Past results do not guarantee future outcomes.

What if the insurer denies your claim?

A denial can be challenged with records, job facts, witness proof, medical reports, and a filing before the workers' comp board.

Insurers may deny San Marino claims by saying the worker was not an employee, the injury happened off duty, or the household had no coverage. They may also blame age, prior pain, or a non-work accident. Do not assume the denial is correct.

After a DWC-1 claim form is filed, the insurer has 90 days to accept or deny. During that period, up to $10,000 in medical care should be authorized. Treatment denials can move through utilization review and Independent Medical Review, usually with a 30-day IMR deadline.

A denied case can be filed at the Pomona WCAB. The evidence may include pay records, texts, witness names, medical reports, job photos, and the QME report. Small-employer facts need careful handling.

How long do you have to file in San Marino?

Tell the employer quickly, ask for the claim form, and protect the one-year deadline for formal filing before delay hurts proof.

Written notice helps. It can be a text, email, or note. Say where you were working, what happened, and which body parts hurt. If symptoms built up over time, the start date may depend on when you knew the disability was work-related.

Where San Marino claims are heard

San Marino workers' comp claims are handled at the Pomona WCAB. That venue commonly hears San Gabriel Valley claims, including cases tied to private homes, schools, construction, and service work.

Local injury settings

San Marino has many claims that do not look like warehouse injuries. Household staff can be hurt lifting, cleaning, or carrying supplies. Gardeners and pool workers face tools, chemicals, ladders, and heat. Huntington Library area workers may deal with grounds, event, food service, and visitor support tasks. Residential remodel crews face falls, cuts, and lifting injuries.

Nearby medical options

For emergencies, call 911. Huntington Hospital in Pasadena and San Gabriel Valley Medical Center are nearby emergency options. After urgent care, the insurer often controls follow-up through a medical provider network.

Proof that helps a San Marino claim

Private-home claims can be proven with small records. Texts about hours, payment notes, house keys, gate codes, task lists, photos, and witness names all matter. A gardener may have route sheets or supply receipts. A nanny may have messages about pickup, meals, and lifting duties. A remodel worker may have contractor texts, photos, or material receipts.

Why these cases need careful handling

San Marino employers are often homeowners, small vendors, or household managers. That can make insurance information hard to find. It can also make injured workers feel nervous about speaking up. We focus on proof first: who hired you, where you worked, what tasks you performed, and what medical care says about the injury.

When a homeowner or small vendor is involved, early letters can help identify insurance before bills pile up. That step can also calm fear about unpaid medical care.

Clear proof also helps when the adjuster questions whether the injury happened during paid work.

Frequently Asked Questions

Do I pay anything up front for a San Marino workers' comp lawyer?

No. The fee is usually a contingency fee approved by the WCAB judge. It often falls between 12% and 15% of the recovery. You do not pay by the hour.

Are housekeepers, gardeners, and nannies covered?

Often yes. Domestic work can be covered when the facts meet California rules. Cash pay or part-time hours do not automatically defeat a claim. The details of employment and insurance matter.

Can I be fired for filing a workers' comp claim?

An employer cannot punish you for filing a claim. Labor Code section 132a can allow reinstatement, lost wages, and a penalty up to $10,000. Save texts, schedule changes, and termination notices.

What if I am undocumented?

Immigration status does not erase California workers' comp rights. You can still seek medical care, disability payments, and claim benefits. Threats about immigration status can also violate California labor law.

How long does a San Marino case take?

It depends on treatment and disputes. A clear strain may resolve faster. A denied domestic worker claim, surgery case, or uninsured employer issue can take longer.

Can I pick my own doctor?

Usually the insurer sends you to a medical provider network. You may be able to change doctors within that network. If you validly pre-designated a doctor before the injury, different rules may apply.

What if the homeowner or small employer has no insurance?

Do not give up. Uninsured employer cases have special rules and possible remedies. You may need to file the comp case and review other options based on the facts.

What proof helps a private-home injury claim?

Keep texts, pay records, job instructions, photos, names of witnesses, medical notes, and the address where you worked. Small details can prove employment and how the injury happened.
