Supplemental Job Displacement Benefit. If your employer cannot return you to your regular duties, you may receive a retraining voucher worth up to $6,000. A Ritz-Carlton housekeeper who can no longer do room turnovers qualifies. So does a landscaper whose shoulder injury ends outdoor work. This voucher covers tuition, books, and licensing fees.

Mileage reimbursement. Every trip to a medical appointment is paid back at the state rate.

What if the insurer denies your claim?

A denial is not the end. You still get up to $10,000 in immediate medical care while the insurer decides. You have clear steps to fight back.

After you file the DWC-1 form, the 90-day decision rule gives the insurer 90 days to accept or deny your claim. If they miss that deadline, the law presumes your injury is covered. During those 90 days, up to $10,000 in medical care must be provided right away. They cannot freeze your treatment while they investigate.

If the insurer denies a treatment your doctor ordered, you can appeal through Independent Medical Review within 30 days. An independent doctor reviews your records and either upholds or overturns the denial. This process moves faster than a full court hearing.

If that fails, you can file a Petition for Reconsideration with the WCAB within 25 days of a mailed decision (or 20 days for electronic service). After that, a Writ of Review can bring the matter to the Court of Appeal within 45 days.

Firing you, cutting your hours, or punishing you for filing a claim is illegal retaliation. You can seek reinstatement, recover lost wages, and add a penalty of up to $10,000 to your award.

You still have a path to benefits. You can file against the Uninsured Employers Benefits Trust Fund, which advances medical care and wage replacement while the case proceeds.
