Step 3: Claim investigation. The insurer has 90 days to accept or deny the claim. During this period, they may send you to their chosen doctor, request a recorded statement, and investigate the circumstances of your injury. Step 4: Ongoing treatment and disability. If the claim is accepted, you continue treatment until your condition reaches maximum medical improvement. You receive temporary disability payments if you cannot work. If the claim is denied, your lawyer files a challenge at the Oxnard WCAB.
Step 5: Permanent disability and settlement. Once your condition stabilizes, a physician evaluates your permanent impairment. This rating drives the settlement negotiation or award that resolves your case.
